Terms and Conditions for River D Rentals

These Terms & Conditions govern the use of the River D Rentals website and the paid restroom trailer rental services provided by River D Rentals, LLC. By using this website, submitting an inquiry, making a payment, signing a Rental Agreement, or booking a rental, you agree to the applicable terms described below.
Rental Services
River D Rentals provides mobile luxury restroom trailer rentals for weddings, private events, corporate events, festivals, community events, and other approved uses.
Availability, pricing, delivery, setup, removal, rental duration, utility requirements, and other rental details may vary based on the event, location, trailer selected, and site conditions. Specific terms for each paid rental are confirmed through the customer's quote, invoice, and/or signed Rental Agreement.
Reservations, Deposit & Payment
A 50% deposit and signed Rental Agreement are required to reserve an event date. A reservation is not confirmed until both the required deposit and signed Rental Agreement have been received by River D Rentals.
The 50% reservation deposit is non-refundable because the selected restroom trailer and event date are removed from availability for other customers.
The remaining balance may be paid at any time before the event but must be paid in full no later than the day of the event. River D Rentals is not required to place the restroom trailer into service until all amounts then due have been paid.
Prices are subject to applicable taxes and any additional delivery, utility, damage, cleaning, fuel, travel, or service charges disclosed in the quote, invoice, Rental Agreement, or otherwise agreed to by the parties.
Delivery, Placement, Setup & Removal
River D Rentals delivers, places, sets up, and removes the rented restroom trailer at the event location agreed upon with the customer.
The customer must provide a safe, reasonably level placement area with adequate access for River D Rentals' tow vehicle and equipment. The placement and access area must be free of hazards and overhead obstructions.
Only River D Rentals or its authorized representatives may move, relocate, transport, connect, disconnect, or reposition a River D Rentals restroom trailer unless River D Rentals provides prior written authorization.
River D Rentals reserves the right to refuse, delay, adjust, or discontinue delivery, setup, or service when site conditions are unsafe, inaccessible, unlawful, or reasonably likely to cause injury or damage to persons, property, vehicles, or equipment.
Water & Electrical Requirements
For one-day rentals, an on-site water connection is not required when River D Rentals determines that the trailer's onboard water capacity is sufficient for the scheduled event.
Rentals lasting more than one day require reasonable access to a suitable water source unless River D Rentals agrees otherwise in writing.
Access to a suitable electrical connection is preferred for all rentals and is especially important for multi-day events. River D Rentals may provide and operate a generator when electrical service is unavailable or unsuitable.
Customers should disclose available water and electrical service before the event so River D Rentals can determine appropriate setup requirements. Generator use, fuel needs, utility limitations, or unusual site requirements may result in additional charges if disclosed in the quote, invoice, Rental Agreement, or otherwise agreed to by the parties.
Customer & Event Organizer Responsibilities
Customers and Event Organizers are responsible for providing accurate event and site information, maintaining reasonable access to the trailer, using the trailer for restroom purposes only, monitoring the trailer during the event, and promptly reporting any issue, damage, or malfunction to River D Rentals.
Smoking and vaping are prohibited inside the restroom trailer. Illegal drugs, illegal activity, and consumption of alcoholic beverages inside the restroom trailer are prohibited. Climbing on or inside the trailer or its mechanical compartments is prohibited. Children must be supervised by an adult.
The customer or Event Organizer may be responsible for vandalism, misuse, theft, intentional damage, negligence, or excessive cleaning caused by the customer, guests, vendors, or other persons with access to the trailer during the event. Normal wear and tear is excluded.
Liability & Indemnification
River D Rentals is not liable for injuries, accidents, or damages resulting from the use of the restroom trailer, except to the extent caused by the gross negligence or willful misconduct of River D Rentals, LLC.
To the extent provided in the applicable signed Rental Agreement and permitted by law, the Event Organizer agrees to defend, indemnify, and hold harmless River D Rentals, LLC, its owners, employees, and agents from claims, injuries, damages, or liabilities arising from the event or use of the restroom trailer, except to the extent caused by the gross negligence or willful misconduct of River D Rentals, LLC.
Weather & Safe Operation
River D Rentals reserves the right to temporarily suspend operation of the trailer, delay service, or make reasonable operational adjustments if severe weather or unsafe conditions threaten the safety of guests, employees, vehicles, equipment, or property.
Weather-related cancellations or changes do not automatically qualify for a refund and are subject to the River D Rentals Refund, Cancellation & Rescheduling Policy and the customer's signed Rental Agreement.
Force Majeure
Neither River D Rentals nor the customer will be liable for failure or delay in performing obligations when performance is prevented or materially affected by circumstances beyond the affected party's reasonable control, including severe weather, natural disasters, fire, flood, government actions or restrictions, road closures, utility interruptions, emergencies, or other unforeseen events that make performance unsafe, unlawful, or impracticable.
If a force majeure event prevents River D Rentals from safely delivering, setting up, operating, servicing, or retrieving the restroom trailer, River D Rentals will make reasonable efforts to communicate with the customer and, when feasible, offer rescheduling subject to trailer availability.
Any deposit, payment, refund, or rescheduling resulting from a force majeure event will be handled in accordance with the Refund, Cancellation & Rescheduling Policy and the customer's signed Rental Agreement unless otherwise agreed to in writing.
Cancellation, Rescheduling & Refunds
If a customer needs to cancel an event or rental, River D Rentals must be notified as soon as possible.
The 50% reservation deposit is non-refundable. Requests to reschedule will be considered based on trailer availability and are not guaranteed.
If River D Rentals approves a rescheduled date, payments may be transferred to the new event date at River D Rentals' discretion. Additional charges may apply if the event location, rental duration, services, utility requirements, or other rental details change.
Any payments made in excess of the required deposit will be handled according to the circumstances and timing of the cancellation and the terms of the customer's signed Rental Agreement. Any exception must be agreed to in writing by River D Rentals.
Insurance
River D Rentals maintains insurance coverage applicable to its business operations. Proof of insurance is available upon request.
Marketing & Photo Release
River D Rentals may photograph or video the restroom trailer and surrounding event area for promotional and marketing purposes, including use on its website, social media, print materials, and advertising. No individual attendees will be intentionally identified without permission.
Website Information
River D Rentals makes reasonable efforts to keep website information accurate and current. Photographs, descriptions, availability, pricing information, service-area information, and other website content are provided for general informational purposes and may be updated from time to time.
Submitting an inquiry, quote request, or other website form does not guarantee trailer availability and does not constitute a confirmed reservation.
Intellectual Property
The River D Rentals name, logo, photographs, graphics, website content, and other original materials may not be copied, reproduced, distributed, or used for commercial purposes without permission from River D Rentals, except where otherwise permitted by law.
Third-Party Services
The River D Rentals website may use or link to third-party services, including payment processors, website providers, social media platforms, mapping services, or other service providers. River D Rentals is not responsible for the content, privacy practices, availability, or operation of third-party websites or services.
Rental Agreement Controls
Each paid reservation is subject to a signed River D Rentals Rental Agreement. If the terms of a customer's signed Rental Agreement differ from these general website Terms & Conditions, the signed Rental Agreement will control for that specific reservation.
Changes to These Terms
River D Rentals may update these Terms & Conditions periodically. Revised Terms & Conditions become effective when posted on the River D Rentals website. The Last Updated date will reflect the most recent revision.
Governing Law
These Terms & Conditions are governed by the laws of the State of Texas, without regard to conflict-of-law principles.
